Zoning Board of Appeals Minutes December 3, 2014
These minutes are not verbatim – they are the secretary’s interpretation of what took place at the meeting – Open Meeting Law – Section III.

Members present:  Peter Conner, David Peck, Michael Main, Edward Conroy, and Mike Leary

Members absent:  William Keohan and James Simpson

Mr. Conner called the meeting to order and explained the procedures for the evening.

Public Hearing:         Plymouth South High School – Case # 3766
                        (Continued from November 19, 2014)
                        490 Long Pond Road
Special Permit per Section 205-17 I(2) Height; and, a Special Permit per Section 205-25 A(3) and 205-57 (AA) Table, extending, altering, reconstructing, and moving pre-existing nonconforming use and structures in the Aquifer Protection District subject to Environmental Design Conditions 205-9-C.

The Board received the following documentation* for review of this case:

  • November 21, 2014 PARE response to Fire Dept. comments dated November 20, 2014
  • Fire Truck Turning Plan dated November 12, 2014
James Jordan, Ai3 Architects, recapped the presentation held on November 19, 2014 and referred to additional documentation that the Board had requested.  He noted that the Fire Departments request for a 3rd party review will be complied with when the construction plans are 90% complete which should be in April 2015.  He reviewed the fire protection requirements and said he would comply with the code as well as continue to work with the Fire Department.  He commented that they now meet the truck turning radius for the Tower 1 Truck.  He reviewed the design concerns of eliminating internal roadways.  He addressed the sidewalk issue and presented an existing conditions plan with the proposed sidewalk extension and addition of a small piece of walkway.

The Chairman closed public comment.  

The Chairman closed the public hearing.

Mr. Main motioned to approve Special Permits for Case No. 3766 with conditions as discussed.  Mr. Peck seconded.  Granted unanimously (4-0)  

Informal Hearing:        Jeannine Anderson Realty Trust & P.A. Landers, Inc. - Case # 3515
         143 Hedges Pond Road
         Condition #8(a) – Extension of excavation period

  • Existing Conditions Plan dated August 22, 2014
Atty. Angley, representing Petitioner, discussed existing conditions.  

The Board and Petitioner reviewed compliance matters and existing conditions.  

Public comment in opposition:   Alexander Lee Burns

Mr. Leary motioned to grant extension for 120 days with a Peer Review report completed and presented to the Board within 90 days.  The Peer Review will be based on reviewing prior Decisions and Conditions of Case No.’s 3086, 3288, and 3515.  Additionally, only 40 truck trips are now allowed and the Petitioner must adhere to the truck route of Hedges Pond Road to Rte. 3A to Route 3.  Mr. Peck seconded.  Granted unanimously (5-0)

Other Business:         Approval of November 19, 2014 ZBA Meeting Minutes

Mr. Main motioned for the Board to approve the November 19, 2014 Meeting Minutes as presented.  Mr. Peck seconded.

Agreed unanimously (5-0)

Mr. Main motioned to adjourn the meeting.  Mr. Leary seconded.  Agreed unanimously (5-0)
